1. Introduction

Welcome to PageantTree.com, the premier online marketplace for pageant-related apparel, services, and accessories. By accessing or using the PageantTree Marketplace ("Marketplace"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not use the Marketplace.

Please also review our Privacy Policy for information on how we collect, use, and protect your personal data.

2. User Eligibility

To use the Marketplace, users must:

  • Be at least 18 years of age or the legal age of majority in their jurisdiction or have parental consent.
  • Provide accurate and complete registration information.
  • Maintain the accuracy of account and listing information at all times.

3. Listing and Pricing Policy

  • Listing Fees: All fees are due at the time of posting or upon sale of the item, depending on the type of listing selected.
  • One Item Per Listing: Each listing must represent a single item or a single matched pair (e.g., suit jacket and pants, top and skirt). Bundling multiple unrelated items into a single listing is not permitted.
  • Category Accuracy: Items must be listed in the appropriate category and subcategory to ensure accurate browsing and search results.
  • Price Accuracy: The listed price must accurately reflect the actual asking price for the item being offered. Users may not misrepresent prices, “lowball” listings, or use artificially low pricing in an attempt to manipulate search results, avoid fees, or mislead buyers.
  • Locked Listings: Once submitted, listings cannot be edited except for the price. To make other changes, users must delete and repost the listing, which may incur a new fee.
  • Policy Enforcement: PageantTree reserves the right to remove, reassign, or restrict listings that violate these policies.

4. Payments, Fees, and Stripe Connect

All payments made through the Marketplace are processed by Stripe, Inc. via Stripe Connect, our third-party payment processor. By buying or selling on PageantTree, you agree to be bound by the Stripe Connected Account Agreement, available at https://stripe.com/connect-account/legal.

PageantTree acts solely as a facilitator of payments between buyers and sellers. PageantTree is not the merchant of record for seller-listed items and does not itself hold buyer funds. All funds are held by Stripe until released according to these Terms.

4.1 Platform Fees

PageantTree charges a base transaction fee of 15% of the final sale price (excluding shipping). The applicable fee is automatically deducted prior to payout. Discounted rates may apply for verified seller tiers in the future.

4.2 Buyer Payments

Buyers must complete checkout through the secure Stripe interface. The total shown at checkout includes item price, transaction fees, and any applicable taxes or shipping charges.

4.3 Payment Security

Stripe uses industry-standard encryption and is a PCI-DSS–compliant payment processor. PageantTree does not store full credit-card numbers or banking credentials.

5. Seller Payout Eligibility & Stripe Onboarding

To receive proceeds from sales made through the Buy Button, sellers must maintain a valid, verified Stripe Connect Express account.

  • Sellers may create listings before completing Stripe verification; however, no payout will be issued until verification is complete.

  • Stripe may require the seller to submit personal or business identification and bank-account information. Failure to complete verification within Stripe's required timeframe may result in cancellation of the transaction and refund to the buyer.

  • By connecting a payout account, sellers authorize Stripe and PageantTree to deduct applicable fees, taxes, refunds, and chargebacks from their earnings.

  • Sellers remain responsible for any chargebacks or refund reversals associated with their transactions.

6. Prohibited Items, Activities, and Brand Violations

The following items and activities are prohibited on the Marketplace and may result in account suspension or removal without refund:

  • Illegal or counterfeit goods.
  • Items that infringe upon intellectual property rights.
  • Misleading or fraudulent content.
  • Attempts to circumvent fees or manipulate listings.

6.1 Brand Compliance and Indemnification

Sellers are solely responsible for ensuring that the items they list and resell on PageantTree comply with all applicable brand owner policies, intellectual property rights, and distribution agreements. This includes, without limitation, any restrictions on resale, online marketplace sales, product alterations, and the use of brand names or trademarks.

By listing an item on the Marketplace, you represent and warrant that:

  • You have the legal right to sell the item;
  • The item is authentic and not materially different from what the brand owner offers unless material differences are described in the listing;
  • Your sale does not violate any brand policy, warranty restriction, or intellectual property right.

You agree to indemnify, defend, and hold harmless PageantTree.com, its affiliates, and their officers, employees, and agents from any claims, demands, damages, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your sale or attempted sale of any product in violation of brand restrictions;
  • Any unauthorized use of trademarks, copyrights, or other protected material;
  • Your failure to comply with applicable laws or third-party policies.

PageantTree reserves the right to remove any listing or suspend any account upon notice of a potential violation.

7. Transactions, Escrow, and Payouts

When a buyer completes checkout, Stripe collects the payment and holds the funds in escrow until the order is marked as completed.

  • Release of Funds: Funds are released to the seller's connected Stripe account only after (a) shipment is confirmed and (b) the buyer marks the order as received or three (3) days have passed without dispute.

  • Failed Onboarding: If the seller has not completed Stripe verification by the time payout is due, the transaction may be reversed and the buyer refunded.

  • Timing: Payouts typically occur within 7 business days after order completion, subject to Stripe's processing times.

  • Refunds: If PageantTree or Stripe issues a refund to a buyer, the corresponding amount will be deducted from the seller's pending or future payouts.

8. Refunds, Disputes, and Cancellations

8.1 Buyer Protection

Buyers may request a refund within seven (7) days of delivery if an item was not received or materially differs from its description. Requests must be submitted through the order-detail page.

8.2 Seller Response

Sellers will be notified of refund requests and may respond with evidence or accept the refund. If the parties cannot agree, PageantTree may, in its sole discretion, issue a refund or release payment.

8.3 Final Determination

PageantTree's decision in any payment-related dispute is final and binding. All refunds are processed through Stripe to the buyer's original payment method.

8.4 Non-Circumvention

All sales initiated on PageantTree must be completed through PageantTree's payment system. Conducting or attempting to conduct off-platform transactions to avoid fees is prohibited and may result in account suspension.

9. User Responsibilities

You are solely responsible for:

  • The accuracy of your listings.
  • Honoring commitments to buyers or sellers.
  • Complying with all applicable laws and regulations.
  • Safeguarding your login credentials.

10. DMCA Policy

10.1 Takedown Requests

If you believe that content on PageantTree infringes your copyright, you may submit a DMCA notice to:

Please include all elements required by 17 U.S.C. § 512(c)(3), including:

  • A description of the copyrighted work.
  • The location of the allegedly infringing material.
  • Your contact information.
  • A statement that you have a good faith belief the use is unauthorized.
  • A statement under penalty of perjury that your notice is accurate.
  • Your signature.

10.2 Repeat Infringer Policy

In accordance with the DMCA, PageantTree.com reserves the right to terminate the accounts of repeat infringers.

11. Taxes and Marketplace-Facilitator Disclosure

Where required by law, PageantTree acts as a marketplace facilitator and may collect and remit sales or use tax on transactions completed through the platform. Sellers authorize PageantTree and Stripe to calculate, collect, and remit such taxes on their behalf. Sellers remain responsible for any taxes not collected or remitted by PageantTree.

12. Dispute Resolution

Users agree to resolve disputes directly between themselves. PageantTree.com does not mediate or arbitrate user-to-user issues. However, payment-related disputes and refund requests are subject to PageantTree's review and decision as outlined in Section 8 (Refunds, Disputes, and Cancellations).

12.1 Arbitration & Class Action Waiver

To the fullest extent permitted by law:

  • You agree to resolve any disputes with PageantTree via binding arbitration, conducted in English, under the rules of the American Arbitration Association.
  • You waive the right to participate in class actions or class-wide arbitration.

This clause does not apply where prohibited by law.

13. Limitation of Liability

To the maximum extent permitted by law:

  • PageantTree.com and its affiliates are not liable for any indirect, incidental, special, or consequential damages, including lost profits or data.
  • Our total liability shall not exceed the amount paid by you to us in the last 12 months.
  • PageantTree shall not be liable for any loss or delay caused by the actions or inaction of Stripe or any other third-party payment processor. In no event shall PageantTree be responsible for amounts greater than the transaction fees it has actually received in connection with the disputed transaction.

14. Disclaimer of Warranties ("As-Is" Disclaimer)

The Marketplace is provided "as is" and "as available". PageantTree makes no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee the accuracy, completeness, or availability of listings or services on the Marketplace.

PageantTree does not warrant or guarantee that payment transactions will be error-free or uninterrupted. All payment services are provided by Stripe under its own terms of service. Any disputes regarding the processing of payments or payouts must first be directed to Stripe.

15. Force Majeure

PageantTree.com is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, internet outages, war, government actions, labor disputes, or pandemics.

16. Data Security Disclaimer

We use commercially reasonable measures to safeguard user data. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Payment information submitted through Stripe is governed by Stripe's own privacy policy. PageantTree does not store financial account numbers or government-ID data collected during seller verification.

17. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes via:

  • Email to the address on file, and/or
  • Platform notifications upon login.

Continued use of the Marketplace after notification constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

19. Media Use Release

By uploading, creating, or posting any images/videos or other media on PageantTree.com, you grant PageantTree, LLC the irrevocable, worldwide, royalty-free right to use, reproduce, publish, display, and distribute those images in connection with the marketing and promotion of PageantTree.com and its services. This includes but is not limited to use on our website, social media channels, email campaigns, advertisements, and promotional materials, whether digital or print.

PageantTree will never sell your images or use them outside the context of promoting the PageantTree platform.
